Payments and Refund Policy

PIPNOTIC Sites uses Stripe Checkout for online payment, order processing, and order delivery. Billing occurs at the time of or shortly after your transaction. You agree that you will pay for all products you purchase through Stripe, and that PIPNOTIC may charge your credit card for any products purchased.

All sales of products are final. Fees paid for products and services are non-refundable.

Prices for products offered via Stripe Checkout may change at any time, and Stripe Checkout does not provide price protection or refunds in the event of a price reduction or promotional offering. If a product becomes unavailable following a transaction but prior to download, your sole remedy is a refund. If technical problems prevent or unreasonably delay delivery of your product, your exclusive and sole remedy is either replacement or refund of the price paid, as determined by PIPNOTIC.

To the maximum extent permitted by law, PIPNOTIC will not be liable for any consequential, incidental, special, direct, or indirect damages (including but not limited to lost profits, trading losses or damages that result from use or loss of use of the PIPNOTIC Sites and third party content, inconvenience or delay). This is true even if PIPNOTIC has been advised of the possibility of such damages or losses.

Except as otherwise required by law, PIPNOTIC will not be liable to you or anyone else for any loss resulting from a cause over which PIPNOTIC does not have direct control. This includes failure of electronic or mechanical equipment or communications lines, unauthorised access, viruses, theft, operator errors, severe or extraordinary weather, fire, war, insurrection, terrorist act, riot, labour dispute, accident, emergency or action of government.

Indemnification

As a condition of your use of the PIPNOTIC Sites, you agree to indemnify and hold PIPNOTIC and its Third Party Content providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from your use of the PIPNOTIC Sites, or from your violation of these Terms.

Confidentiality

It is your obligation to keep PIPNOTIC account information and passwords confidential. You acknowledge and agree that any instruction or communication transmitted to you or on your behalf via any PIPNOTIC Site is made at your own risk. You authorise PIPNOTIC to rely and act on any instruction given to PIPNOTIC that PIPNOTIC believes to have been given by you or on your behalf by any duly authorised agent or intermediary.

Termination

PIPNOTIC reserves the right to terminate your usage of the PIPNOTIC Sites at any time, for any reason, with or without cause and without prior notice. PIPNOTIC is not responsible for cancelling subscriptions and any fees incurred as a result of subscriptions not being cancelled in a timely manner are non-refundable.

Governing Law and Jurisdiction

Unless otherwise agreed, these Terms and Conditions and their enforcement are governed by the laws of Denmark, without regard to principles of conflicts of law. You irrevocably agree to submit to the jurisdiction of the courts located within Denmark. Nothing herein shall prevent PIPNOTIC from bringing any action in the courts of any other jurisdiction.

Pipnotic Software End User License Agreement

PIPNOTIC is willing to license the software to you only upon the condition that you accept all of the terms contained in this EULA. By using the software you acknowledge that you have read the terms and agree to them.

Grant of License

PIPNOTIC grants you the right to install, use, access, display and run the Software on any computer or mobile device that you own or control, for personal, non-commercial use, provided that you comply with all terms and conditions of this EULA.

Scope and Limitations

You may not rent, lease, lend, sell, redistribute, reuse, retransmit, sub-licence or exploit the Software. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Software. The Software is not intended for distribution to, or use by, any person in any country or jurisdiction where such distribution or use would be contrary to local law or regulation.

Professional and Commercial Use

The displayed prices and associated data are provided for personal use only. Professional or commercial use requires a separate license. For the purposes of this EULA, professional and commercial use refers to any application of the software in the context of a business or institution where the software contributes directly or indirectly to financial gain — including use within institutional trading environments, as part of a product offered to clients, by individuals managing client accounts, within a trading education or signal service, or by analysts and researchers in financial roles.

Personal use is limited to individual traders using the software solely for their own private trading and learning purposes, without any form of compensation or affiliation with a business entity.

No Warranty

PIPNOTIC does not make any express or implied warranties about the software, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The software is made available "as is" and "as available".

Limitation of Liability (EULA)

To the extent permissible by law, in no event shall PIPNOTIC, any third party content provider, or any affiliates be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever arising out of or related to your use or inability to use the software.

Governing Language

Any translation of this License is done for local requirements or your convenience. In the event of a dispute between the English and any non-English versions, the English version shall govern, to the extent not prohibited by local law.

Modifications to the EULA

PIPNOTIC reserves the right to change the terms and conditions of the EULA at any time with or without notice. You are responsible for regularly reviewing these terms and conditions for any modifications.
